1.4    Customer: an individual who uses the services provided by After My Death to store information and online assets for release after their death.

1.5    Data Protection Laws: all applicable laws and regulations relating to the processing of personal data and privacy, including, where applicable, the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and any other applicable national implementing laws, regulations, and secondary legislation, as amended or updated from time to time.

1.6    Nominees: the individuals or entities appointed by the customer to manage and distribute their stored information and online assets after their death, as defined in the Terms and Conditions.

1.7    Personal Data: any information relating to an identified or identifiable natural person, as defined in the UK General Data Protection Regulation (UK GDPR).

1.8    Policy: this Website Privacy and Cookies Policy, which sets out the principles and guidelines for the collection, use, and protection of Personal Data by After My Death.

1.9    Terms and Conditions: the legal agreement between After My Death and the customer governing the use of the company's services.

9    Keeping Personal Data secure

9.1    We will use technical and organisational measures to safeguard your Personal Data, for example:

 

9.1.1    we store your Personal Data on secure servers; and

 

9.1.2    payment details are encrypted using SSL technology (typically you will see a lock icon or green address bar (or both) in your browser when we use this technology).

 

9.2    Technical and organisational measures include measures to deal with any suspected data breach. If you suspect any misuse or loss or unauthorised access to your Personal Data, please let us know immediately by contacting us.

12.2    After My Death does not transfer Personal Data to countries outside the European Economic Area (EEA) or to third countries that have not been deemed adequate by the European Commission, except: (1) as necessary to fulfil the Customer’s explicit instructions regarding the release of stored information and online assets to Nominees and Beneficiaries, as defined in the Terms and Conditions; or (2) where appropriate safeguards are in place as required by applicable data protection laws.

 

12.3    In the event that any transfer of Personal Data outside the EEA is required, such transfer will be conducted in compliance with data protection legislation, ensuring that adequate safeguards are in place to protect your Personal Data, including but not limited to the use of Standard Contractual Clauses adopted by the European Commission in June 2021 or the UK addendum to the same.

 

13    Changes of business ownership and control

13.1    After My Death may, from time to time, expand or reduce its business and this may involve the sale and/or the transfer of control of all or part of After My Death. Personal Data provided by Customers will, where it is relevant to any part of our business so transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Policy, be permitted to use the Personal Data for the purposes for which it was originally supplied to us.

 

13.2    We may also disclose Personal Data to a prospective purchaser of our business or any part of it.

 

13.3    In the above instances, we will take steps with the aim of ensuring your privacy is protected.
